1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Pivra.ai (the "Service"), operated by Bluebird Technologies Pty Ltd ("Company", "we", "us", "our").

By accessing or using the Service, you agree to be bound by these Terms. If you use the Service on behalf of a business or other entity, you represent and warrant that you have authority to bind that entity. If you do not agree, you must not use the Service.

2. Description of the Service

Pivra.ai provides AI-powered chatbot, automation and related tools. The Service may evolve over time. We may modify, suspend or discontinue features at our discretion.

3. Eligibility

You must:

  • Be at least 18 years old
  • Use the Service in compliance with all applicable laws
  • Not be prohibited from receiving services under Australian law

4. Acceptable Use

You must not use the Service:

  • For unlawful, misleading, deceptive or fraudulent purposes
  • To generate illegal, harmful, abusive or defamatory content
  • To infringe intellectual property rights
  • To process regulated or sensitive data without lawful authority
  • To reverse engineer or interfere with the Service
  • To bypass usage limits, security mechanisms or billing systems
  • To resell or sublicense the Service without written consent

You are solely responsible for all content uploaded, all chatbot deployments, all outputs generated, and compliance with laws applicable to your industry.

5. AI Output Disclaimer

The Service uses artificial intelligence systems. You acknowledge that:

  • AI-generated outputs may be inaccurate, incomplete or biased
  • Outputs do not constitute legal, medical, financial or professional advice
  • You must independently verify outputs before relying on them
  • We are not responsible for decisions made based on AI outputs

Use of AI outputs is at your own risk.

6. User Content

You retain ownership of content you upload ("User Content"). You grant us a worldwide, non-exclusive, royalty-free licence to store, process, transmit and display User Content solely to provide and improve the Service. You warrant that you have all necessary rights to upload and use such content.

7. Fees and Billing

Paid plans are billed in advance in AUD and are processed via Stripe. Fees are non-refundable except where required by law. We may change pricing with reasonable notice and may suspend accounts for non-payment. GST and other taxes may apply.

8. Intellectual Property

All intellectual property rights in the Service remain the exclusive property of Bluebird Technologies Pty Ltd. Nothing in these Terms transfers ownership of the Service to you.

9. Third-Party Services

We use third-party providers (e.g. hosting, AI models, analytics, payment processors). We are not liable for failures, downtime, data breaches, acts or omissions, or service interruptions caused by third parties.

10. Warranties Disclaimer

To the maximum extent permitted by law, the Service is provided "as is" and "as available". We do not warrant continuous availability, error-free operation, fitness for purpose, or accuracy of outputs. Nothing excludes rights under the Australian Consumer Law that cannot be excluded. Where liability cannot be excluded, it is limited to resupply of the services or payment of the cost of resupply.

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential loss; loss of profits, revenue, goodwill or data; business interruption; or regulatory penalties resulting from your use.

Our total aggregate liability is limited to the total fees paid by you in the 12 months preceding the claim. If you use a free plan, liability is limited to AUD $100. Directors, officers, employees and contractors of Bluebird Technologies Pty Ltd have the benefit of these limitations.

12. Indemnity

You agree to indemnify and hold harmless Bluebird Technologies Pty Ltd and its directors, officers, employees and contractors from any claims, liabilities, damages, penalties, regulatory actions, costs or legal expenses arising from your use of the Service, your breach of these Terms, your User Content, claims by your end users, or your failure to comply with applicable laws.

13. Suspension and Termination

We may suspend or terminate access immediately if you breach these Terms, if required by law, or if continued use presents legal, financial or reputational risk. You may cancel at any time. We may delete data after a reasonable retention period following termination.

14. Data Backup

You are responsible for maintaining independent backups. We are not liable for data loss.

15. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales.

16. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or in-app notice. Continued use constitutes acceptance.
